Today I got this news from Lurch, aka Kirk, Cindi's husband:

"We must maintain the chemotherapy for 16 more visits (approximately one year) and maintain the files necessary for our TDM1 trials. The cancer did not show up in the PETscan. We still have cancer in the system, but the cancer is lying dormant and not metastisizing."

Unfortunately Lurchie hurt his back and may be off work 6 months or more! He has to go through therapy.  This wasn't a work related injury so that's not a good thing. 

Please keep Cindi and Lurch in your prayers!

Awesome news today!

Cindi just announced that she had her PET scan results today and her cancer IS IN REMISSION!  How awesome is that?!?!

Keep praying for Cindi and Kirk that they can keep fighting the battle for their home and that Cindi's body will continue to heal!

Just keep on keeping on....

Cindi and Kirk are still battling cancer. Cindi is in a trial and I believe, goes to chemo every three weeks.  Just a few days ago, she posted this on facebook, "I'm here ya'll, just dealing with post chemo crappiness. Headaches, fevers, and aches and pains." Kirk is taking good care of her!

Even though Cindi goes through this sickness and pain, she still is involoved with the Gretta's Wish charity in Charlotte. This charity collects dog food from neighbors who generously give to the program, and Cindi and her friends distribute it out to those who have fallen on hard times and can't afford to feed both themselves and their pets. I don't know how she does it!

News anchor at WCNC in Charlotte, Bill McGinty, has been following Cindi's story and recently visited them at their home to do a follow up segment for the nightly news. I'll post it when it airs.

I haven't been posting here for a while, because there isn't really much news. Cindi is still battling her cancer.  The lawyer is making progress and I believe that Wells Fargo is going to get a butt chewing from a judge, if they already haven't. Unfortunately, that might not be enough to keep them from starting the foreclosure process again. I'll post more when I know more.

Merry Christmas, and a Happy New Year!


It's been a long two months and I am happy to say, Cindi and Kirk are still in their home!  The lawyer continues to work with the bank on the issues and so far, Wells Fargo is behaving.  Lets all pray that they continue to leave the Davis' alone or at least, work with them to come to a resolution.  Cindi is not able to comment much on the happenings with the law firm, as all negotiations are confidential, at this point.

Cindi and Kirk have not decorated their home for the last 4 years, never knowing when she might be left homeless.  This year, with the help of news anchor Bill McGinty, the legal team and all the wonderful people praying and donating to Cindi's fund, the Davis' have hope and felt comfortable enough to decorate their yard for Christmas!

Cindi continues to receive chemo for her stage 4 breast cancer, and is currently taking part in a trial drug that is very promising!

Finally....an update!

I am SO sorry for not keeping up with this blog.  Life took me in a direction that has kept me busy (with my own home daycare) and I have neglected this site!

Cindi has been approved for a trial chemo which I will post about tomorrow when I gather all the info.

Bill McGinty is going to do an update on the news sometime this month.

The lawyers are still hard at work trying to save the home and I think are winning!  I'll try to get an update soon.

The petition reached over 150,000 signatures!  You can sign it by clicking the link to the right.

Donations are still being accepted by clicking the link to paypal.  To the person who sent me a check, I did receive it but was unable to understand your email address to send you a confirmation of receipt.

Again I'm sorry to those of you who have checked back for updates and found none.  I will do much better at keeping you posted.

There has been another push on Change.org for the petition that we have for Cindi and Kirk Davis and over this weekend, we've received over 30,000 more signatures! 

We have had 3 requests for the name of the trust and 9 donations! 

THANK YOU to EVERYONE who is helping out with Cindi's story!  Thanks to Change.org for helping to get the word out.  Thanks to Kate Livingston who is in charge of the petition and thanks especially to the PUBLIC for all your hard work to let people know what's going on and for your donations!!

I checked into another source for donating and while it's rates were less .25cents per transaction, it's comments by users wern't so great. I do not want to put our donators in jeopardy of having issues with a company that has less than stellar practices.

So, I guess we'll hang tight with PayPal for now.

Have you signed the petition?

In the last 24 hours, we have seen the petition signatures climb from 18,000 to almost 66,000!  Kate Livingston, on Twitter @NMWriterofWords, told me today that 20/20 and Nightline both re-tweeted the change.org petition link!  Please follow Kate and re-tweet all her tweets in reference to Cindi's story!  Kate is doing an excellent job at getting the word out about the petition!

If you have not signed the petition, please see the link to the right, just below the three news stories from WCNC.

We are asking that if everyone would donate just $1, we could pull the Davis's out of this nightmare they are finding themselves in.  We only have one issue with this that I need to figure out first.  Fees.

PAYPAL FEES

I am seriously thinking about changing the way we collect donations.  PayPal's fees don't seem to be that much, but when you add up what they've received from us so far, it just seems like we're throwing money away.

The fee for PayPal is 2.9% plus a .30 cent tranaction fee. So, if you give $1 via PayPal,  .33 cents is taken in fees.  If you give $20,  .88 cents is taken.  A $100 donation has a fee of $3.20.

So you see, I'd like to ask that with each signature on the petition, you'd generously give $1.00 but PayPal would take .33 cents!

If we were able to become a non-profit organization, PayPal would waive fees but this is not possible as per the IRS, the funds would have to benefit more than one single individual.

If anyone has an idea of a better means to collect donations without the fees, please let me know!

Please keep in mind that when you donate directly to the Bank of America,  100% of the money goes to Cindi and Kirk!  You MUST give them the name of the trust.  For some strange reason, the Bank of America has a policy of not allowing trustees to post the name of the trust on blogs, Facebook, etc.  It is only allowed to be given out via email or on news sites.

So, please email me at Marsha6814@yahoo.com and I will give you the name of the trust.  I would love to post it here but do not want Bank of America to shut down my account with them.

Petition signatures reach 5000!

Thanks to everyone who has signed the petition!  If you haven't yet, there's a link just below the third news story on Cindi, to the right.

There will be another follow-up on the recent happenings, with Cindi and Kirk, on WCNC News 36 out of Charlotte, NC.  I believe it's going to be on this week! I will post the link as soon as I have it.

The picket has been postponed....

Due to current happenings, the picket has been put on the back burner.  To all those who emailed me about wanting to join in, thanks and I'll keep you posted here!

Important Legal stuff...things you should know.

We would like to make a few things clear when asking for donations for the Davis's trust account.

1) We are NOT a non-profit, 501(c)(3).  To be able to be a non-profit we have to be an "organization".  Since our donations go directly to a single individual (Cindi Davis), we cannot apply for tax exempt status.  This trust account has it's own EIN number registered with the IRS, and all donations are being recorded and reported.

2)  Your donations are NOT tax deductable.  I am sorry, I wish they were.  If you have any idea how we can fix this, please let me know!

3)  The funds being deposited into the trust are going directly to the Davis's medical bills and travel expenses to and from appointments, etc.  As you can imagine, when you are faced with $1,100 in perscriptions alone, the bills are overwhelming. Your donations help ease the burden on Cindi as she bravely battles Stage 4 breast cancer.

WELLS FARGO LIES on Dr. Drew Interview!

Wells Fargo said this in a statement to Dr. Drew:

"We've been working with them since 2008 and since that time have offered MULTIPLE modifications and other workout options. The tentative foreclosure sale date has been suspended until after the start of the new year to allow us more time to work with Mr. and Mrs. Davis."

This is a lie!

They wouldn't know what "working with someone" meant if it jumped up and bit them!

The original court date was set for November 21st with a sale date on the courthouse steps of December 19th.

The new court date has been set for Jan 3rd.

This is ONLY to keep Wells Fargo from looking like a donkey's butt. They know the public is watching and that they are under a microscope now. They wouldn't dare put them out on the street, 6 days before Christmas, with the whole world watching!

LISTEN WELLS FARGO, WE ARE NOT GOING AWAY.

You have NEVER 'worked with them'. You've always worked against them.  

The Davis's don't want a hand out....they want you to HONESTLY work the numbers and give them something they can afford to pay back!
